Public Notice for Setback Variance Request
BAY CITY PLANNING COMMISSION
PUBLIC HEARING NOTICE
FOR A SETBACK VARIANCE #V-2023-03
The Bay City Planning Commission will conduct a hearing on Wednesday, August 16, 2023 at the Ad Montgomery Community Hall located at 5525 B Street, Bay City Oregon. The hearing will begin at 5:30 p.m. with the following matters to be considered:
Description of Project
APPLICATION #V-2023-03 FOR A SETBACK VARIANCE from Brandon Bryner. The applicant is requesting to reduce the required street side yard setback by 3 feet from the required 15 feet to 12 feet, at property located at 6850 Seattle Avenue, Bay City, OR 97107, legally described as 1S1002BA02700, in the Moderate Intensity (MI) Zone. The applicant is in the process of developing the subject property for a single-family dwelling with a separate garage. The setback variance requested is from the required 15ft street side yard setback to 12 ft.
Public Hearing Criteria
The applicable criteria by which the setback variance application will be evaluated by the Planning Commission are located in the Bay City Development Ordinance No. 374, Article 6, Section 6.035 Criteria for Granting Variance; Article 3, Section 3.3 and Section 3.302, Setback Requirements; and Article 1, Section 1.508 Moderate Intensity (MI) Zone Standards.
Appeals to the City Council are limited to only persons who have presented written and/or oral testimony at the hearing(s) before the Bay City Planning Commission. Failure to raise an issue at the public hearing, in person or by letter, or the failure to provide sufficient specificity to allow the Planning Commission an opportunity to respond to the issue precludes an appeal to City Council on that issue. Unless there is a continuance, if a participant so requests, the record shall remain open for at least seven (7) days after the initial evidentiary hearing. The Planning Commission reserves the right to modify the proposal, or continue the hearing to another date and time. If the hearing is continued, no further public notice will be provided.

Materials pertinent to the request are available for review at the Bay City, City Hall, 5525 B Street, Bay City Oregon. A staff report will be available for inspection seven (7) days prior to the hearing and may be obtained at a reasonable cost. All interested parties are invited to express their opinions for or against the request at the hearing or by letter addressed to the Planning Commission, City Hall, PO Box 3309, Bay City, Oregon, 97107.
