CONDITIONAL USE PERMIT #CU-2022-04

VARIANCE #V-2022-05

 

The Bay City Planning Commission will conduct a hearing on Wednesday, November 16th at the Ad Montgomery Community Hall located at 5525 B Street, Bay City Oregon. The hearing will begin at 6:00 p.m. with the following matter to be considered:

 

Description of Project

APPLICATION #CU-2022-04 FOR A CONDITIONAL USE PERMIT from Nathaniel Palmer. The applicant is requesting to place higher density residential with 12 2-bedrom units (6 duplexes) onsite, at property located at the southeast corner of 4th Street and A Street, Bay City, OR 97107, legally described as 1N1034DD Tax Lot 2100, in the North High Intensity (NHI) Zone.

 

Public Hearing Criteria

The applicable criteria by which the conditional use permit application will be evaluated by the Planning Commission are located in the Bay City Development Ordinance No. 374, Article 1, Section 1.4 High Intensity and Section 1.403 North High Intensity Area (NHI), Section 1.406 High Intensity Zone Standards, ; Article 2, Conditional Uses, Section 2.2 Conditional Use Standards, Section 2.201, Multifamily, Cluster, or Apartment Dwellings, Section 2.215, General Conditional Use Standards, Section 2.215.c.2.,Genera Environmental Standard Variance Criteria; Article 3 Supplementary Provisions, Section 3.5 Parking Standards, Section 3.96 Architectural Review; Article 4, Information Required for A Land Use Planning Application, Section 4.113.b, Building Variances; Article 6, Section 6.030 Criteria for Granting a Variance. Appeals to the City Council are limited to only persons who have presented written and/or oral testimony at the hearing(s) before the Bay City Planning Commission.

 

Failure to raise an issue at the public hearing, in person or by letter, or the failure to provide sufficient specificity to allow the Planning Commission an opportunity to respond to the issue precludes an appeal to City Council on that issue. Unless there is a continuance, if a participant so requests, the record shall remain open for at least seven (7) days after the initial evidentiary hearing. The Planning Commission reserves the right to modify the proposal, or continue the hearing to another date and time.  If the hearing is continued, no further public notice will be provided.

Materials pertinent to the request are available for review at the Bay City, City Hall, 5525 B Street, Bay City Oregon.  A staff report will be available for inspection seven (7) days prior to the hearing and may be obtained at a reasonable cost.  All interested parties are invited to express their opinions for or against the request at the hearing or by letter addressed to the Planning Commission, City Hall, PO Box 3309, Bay City, Oregon, 97107.
